A binding repetitive thesis is a thesis fixed to govern all identical cases. When the same question of law multiplies across countless cases, the TST judges it under the repetitive-appeals procedure (art. 896-C of the CLT) — or the courts open an incident for the resolution of repetitive demands (art. 976 of the CPC). The resulting thesis is of mandatory observance by the lower instances (art. 927 of the CPC).
Unlike a summary, which is persuasive, the repetitive thesis binds: it defines the outcome of an entire class of disputes. Recognizing that an award is under a binding thesis is often to know its result in advance.
