What is Outsourcing (terceirização)?

Outsourcing is contracting services through an intermediary company. Since Law 13.429/2017 (and the Supreme Court’s ruling), it is lawful even in the core activity. The client is subsidiarily liable for labor credits if the provider defaults and the client was at fault in oversight (Súmula 331 of the TST).

Unlawful outsourcing (mere labor brokering, with subordination to the client) creates a direct employment relationship.
