What is On-call duty (sobreaviso)?

On-call duty is the time in which the employee, outside the working day, remains available awaiting a call, paid at 1/3 of the normal hour (art. 244, §2º, of the CLT). Merely carrying a mobile phone or telematic device does not constitute on-call duty; the right arises only when the worker remains on standby, with freedom of movement restricted (Súmula 428 of the TST).

The defense disputes the actual restriction and the call records.
