What is Ordinary appeal (recurso ordinário)?

An ordinary appeal is the avenue that takes the judgment to review by the Regional Labor Court (art. 895 of the CLT). With broad devolutive effect, it allows both the facts and the law to be re-argued, within eight days, and from the company it requires payment of the appeal deposit and court costs as a condition of admissibility.

Once decided, it gives rise to the appellate ruling. It is the point at which most cases that rise on appeal are actually decided — beyond it, access to the TST by appeal of review is far more restricted.
