What is Jurisprudential guideline (orientação jurisprudencial)?

Also: orientação jurisprudencial · OJ · jurisprudential guideline

A jurisprudential guideline is the understanding settled by the TST’s subsections on a not-yet-summarized matter. Issued by the Subsections for Individual Disputes (SDI-1 and SDI-2) and for Collective Disputes, guidelines play, in practice, a role similar to that of summaries: they record the court’s settled position and guide the lower instances. Many are, in time, converted into summaries.

For the litigant, guideline and summary form the same map: the body of settled case law that defines the terrain on which each argument will be judged.

How LABORIS AI uses it

LABORIS AI treats summaries and jurisprudential guidelines as the normative backdrop of each award, against which it measures how the regional courts and the local courts actually decide.
