What is Joinder of parties (litisconsórcio)?

Joinder is the gathering of parties on the same side of the case. It may be on the plaintiff side (several workers) or the defendant side (several companies), formed by a community of rights, a connection of claims or an affinity of questions (art. 113 of the CPC). On the defendant side, it is the typical procedural form of holding an economic group liable, whose companies answer jointly (art. 2º, §2º, of the CLT).

Recognizing defendant-side joinder is essential for the monitored company: it may be a defendant in a case whose plaintiff was never its direct employee, but that of an affiliate.
