What is Dismissal for cause (justa causa)?
Also: justa causa · dismissal for cause · dismissal for serious fault
Dismissal for cause is dismissal for a serious fault by the employee. The list is exhaustive (art. 482 of the CLT): dishonesty, misconduct, indiscipline, insubordination, job abandonment, drunkenness, acts against honor, among others. Once recognized, the employee loses prior notice, proportional 13th and vacation, the 40% penalty and unemployment insurance.
It requires robust proof, immediacy and proportionality — and there can be no double punishment for the same fact.
How LABORIS AI uses it
