What is Piercing the corporate veil (IDPJ)?

The IDPJ (incident to pierce the corporate veil) redirects enforcement to the shareholders when the company has no assets to pay the credit (art. 855-A of the CLT, applying arts. 133 to 137 of the CPC). In the labor process the “lesser theory” is generally adopted: mere insolvency suffices, without requiring proof of fraud.
It reaches current shareholders and, in certain cases, departing ones (art. 10-A of the CLT), with their own adversarial process.
