What is Equal pay (equiparação salarial)?

Equal pay is the right to equal salary for work of equal value, for the same employer and in the same locality (art. 461 of the CLT). After the Reform, it requires a difference of up to 4 years in the role and up to 2 years in employment between the claimant and the comparator, and it is removed by a career structure or an approved plan.
The proof compares functions actually performed — not the role on paper (the primacy-of-reality principle). Details in Súmula 6 of the TST.
