What is Defensibility (defensibilidade)?

Defensibility is how well a defense holds up — the complement of the probability of conviction, weighted by the available evidence and the pattern of the court and judge. High defensibility shows where to litigate; low defensibility, where a settlement tends to come out cheaper.
It is not optimism: it is an estimate over real decisions and over the evidence the company actually holds.
