A statement of defense is the pleading in which the defendant company answers. Under the principle of concentration (art. 336 of the CPC), it must gather all defensive matter — preliminary objections and merits — challenging each claim specifically, on pain of the uncontested facts being presumed true.
The strength of a defense lies less in rhetoric and more in the documentary evidence that accompanies it: time records, payslips, termination forms, collective agreements. It is the cross-check between the claim and that record that decides most awards.
