A meal allowance is the benefit that covers the employee’s meals. What is litigated is its nature: paid habitually and in cash, outside the PAT and without a collective-agreement provision, it tends to integrate the salary (Súmula 241 of the TST), with reflex effects; enrolled in the Workers’ Food Program (Law 6.321/1976) or defined as indemnity in a collective agreement, it does not (art. 457, §2º, of the CLT).
The difference is financially decisive: salary nature multiplies the amount through reflex effects, while indemnity nature limits it to the benefit itself.
